YORKSHIRE MEMORIALS WORKMANSHIP AND FIXING GUARANTEE

The guarantees subject to the conditions set out below that should any memorial supplied prove to be faulty in workmanship or materials (fair wear and tear excepted), within 6 years, or within the case of fixing 39 years, of the memorial being fixed in a cemetery, churchyard or other place, the memorial will be made good or if this is not possible, replaced without any expense to the purchaser.

CONDITIONS

As natural materials vary from time to time in colour and texture, this guarantee relates only to the type and soundness of the material and not to its colour or texture. This guarantee shall not apply to any painting or gilding on the memorial or any vases, photo ceramics, bronze ware, plaques or any other decorative or ornamental accessory where fixed or otherwise including any subsequent additions or replacements This guarantee shall not apply to any damage caused by a third party, and shall become invalid if the memorial is removed, disturbed or otherwise worked upon by anyone, including the grave owner and cemetery operatives, other than the seller, its servants or agents.

This guarantee applies only where an order clearly stating the type of material, the finish the dimension of the memorial and the full text of the inscription has been signed by the purchaser and received by the seller. This guarantee shall not apply if the grave has been unreasonably "back filled" resulting in subsidence and heave or if the general ground condition has been subject to subsidence or heave. It does not apply if work on an adjacent plot undermines the memorial through subsidence or movement. The guarantee shall not apply if the installation was subject to cemetery or churchyard regulations that conflicts with the National Association of Memorials Masons Code of Working Practice. Or if the foundations supplied by the burial authority are considered inadequate within the NAMM Code of Working Practice. This guarantee shall not apply if the memorial has been subject to either impact by a vehicle, other mechanical device, trees, lightening strike, flood or water whatsoever. This guarantee shall not apply if the memorial has been subject to vandalism or criminal damage This guarantee shall not apply if the memorial has been subject to stability assessment testing, the method of which has not been accepted by the National Association of Memorial Masons as appropriate.

Yorkshire Memorials, hereby guarantee that the fixing of the memorial conforms to the recommendations of the National Association of monumental mason's code of working practice and that all methods and materials supplied by us and used in the fixing of the memorial are within those guidelines at the time of fixing. Exclusions to the Guarantee of Conformity are that NO outside interference has altered the state of the memorial from its original fixed condition. Which includes:- Damage caused by vandalism or any other third party. Damage caused by any contractors or workmen other than the staff of Yorkshire Memorials, including:- Lawn mowers, ride on tractors, excavators and other plant or implements. Ground subsidence. Damage by falling trees, branches or other debris. Flooding or other acts of God. Any guarantee shall be invalid if the memorial is worked upon, disturbed, altered or amended by any other party other than the staff of Yorkshire Memorials. This guarantee shall not apply if the memorial has been subject to stability assessment testing without prior notice being giving to the purchaser and or supplier, giving them the opportunity to be present at the time of testing.
